San Antonio Man Sentenced to Nearly Six Years in Federal Prison for Gun Trafficking

Alcapone Maximus Pena, 23, of San Antonio, has been sentenced to 70 months in federal prison for his role in a conspiracy involving the theft and trafficking of firearms.  

According to court documents, between January and October 2023, Pena participated in the theft of firearms and vehicles in the San Antonio area and the illegal sale of those stolen firearms. Pena, along with codefendant Nathan Tyler Padilla, 27, and others, repeatedly broke into vehicles believed to contain firearms.  

A search of Pena’s residence on October 25, 2023, resulted in the seizure of 14 firearms. An additional 17 firearms trafficked by Pena were later located. The investigation revealed that Pena was responsible for the illegal trafficking of 25 to 99 firearms. Padilla’s cell phone records also placed him at the scene of several of the firearm thefts, and he received a portion of the proceeds from their sale.

Both Pena and Padilla pleaded guilty on January 7, 2025. Padilla was previously sentenced on April 1 to 90 months in federal prison.  

Acting U.S. Attorney Margaret Leachman emphasized the importance of holding firearm traffickers accountable, noting the high number of guns stolen from vehicles in San Antonio each year and their potential use in violent crimes. Special Agent in Charge Michael Weddel of the ATF Houston Division highlighted the commitment of law enforcement partners to protecting the community by bringing individuals involved in gun theft and trafficking to justice.  

The ATF investigated the case, and Assistant U.S. Attorney Zack Parsons prosecuted it.
